SDA SEEKS TERMINATION OF DOMINO AGREEMENTS

The SDA has filed application in the Fair Work Commission to terminate the workplace agreement covering Dominos pizza delivery drivers

 

The application is based on an analysis of the Domino’s agreement against the Fast Food Award as part of the SDA compliance audit.

 

A key element of the agreement was an attempt to classify drivers as employees rather than contractors.

 

While SDA has been a part of the agreement, it has also been highly critical of several of the clauses including the rates for delivery drivers.

 

The SDA analysis finds the agreement deficient in a number of ways including Sunday penalty rates

 

“The Dominos Agreement is an agreement that does not meet the standards of industrial law as interpreted by the Coles BOOT decision.

 

“We filed to cancel this agreement in 2016 arguing the agreement needed to increase weekend penalties.

 

“Further negotiations failed to resolve the issue and the SDA has recently moved to cancel the agreement.

 

“We want drivers to be regulated with fair wages and conditions – this agreement clearly deficient in that regard.

 

“This highlights again yet again why workers need to be part of their union.”
